asked the
Minister for Tourism, Transport and Communications
if he will outline (1) the powers Aer Rianta have regarding the compulsory acquisition of land, (2) the circumstances under which these powers may be used and (3) the procedures which must be followed.
Minister for Tourism, Transport and Communications (Mr. S. Brennan):
Aer Rianta have no powers to acquire land compulsorily.
The Air Navigation and Transport Act, 1936, as amended by the Air Navigation and Transport Act, 1950, empowers the Minister for Tourism, Transport and Communications to acquire land compulsorily for any purpose related to the development of civil aviation. The procedures which must be followed are set out in section 41 of the 1936 Act.
