  136.  Mr. Briscoe  Information on Ben Briscoe  Zoom on Ben Briscoe   asked the Minister for the Environment  Information on Brendan Howlin  Zoom on Brendan Howlin   if the open air burning of waste paper and office waste contravenes any regulations; and if he will make a statement on the matter. [4869/97]

Minister for the Environment (Mr. Howlin): Information on Brendan Howlin  Zoom on Brendan Howlin  Section 24 of the Air Pollution Act, 1987 places a general duty on the occupier of any premises, other than a private dwelling, to limit/prevent emissions. Further, the occupier of any premises must not permit emissions which cause a nuisance. Section 26 empowers a local authority to serve a notice on the occupier of any premises from which there is an emission requiring that specific measures be taken to limit/prevent such emissions and, under section 28A, any person may seek a court order in respect of unauthorised emissions. The court may order the termination of the emissions, remedying of the effects or the payment of compensation.
