if the open air burning of waste paper and office waste contravenes any regulations; and if he will make a statement on the matter.

Minister for the Environment (Mr. Howlin):
Section 24 of the Air Pollution Act, 1987 places a general duty on the occupier of any premises, other than a private dwelling, to limit/prevent emissions. Further, the occupier of any premises must not permit emissions which cause a nuisance. Section 26 empowers a local authority to serve a notice on the occupier of any premises from which there is an emission requiring that specific measures be taken to limit/prevent such emissions and, under section 28A, any person may seek a court order in respect of unauthorised emissions. The court may order the termination of the emissions, remedying of the effects or the payment of compensation.
