176. Mr. Yates asked the Minister for Agriculture and Food if a person (details supplied) in County Wexford will have 1999 entitlement to ewe premium and 1998 suckler cow premium payments approved; if so, when approval will issue; and the level in this regard. [12907/99]
Minister for Agriculture and Food (Mr. Walsh): The person concerned applied for 162 ewes under the 1998 ewe premium scheme. Following an inspection of the flock on 31 March 1998 only 94 ewes were found. He was, therefore, deemed to have made an intentional false declaration and was debarred from the scheme for two years (i.e. 1998 and 1999 schemes). He has appealed this decision. This appeal is presently under consideration and a decision is expected shortly. He applied under the 1999 ewe premium scheme in respect of 94 ewes but he is not entitled to payment on the basis of the decision debarring him from the 1998 scheme.
The person named applied for 17 cows under the 1998 suckler cow premium scheme on 28 October 1998. At a herd inspection carried out on 3 December 1998 the person named presented two animals which were deemed not to have calved and were therefore not eligible under the EU regulations governing the scheme. The resultant penalty applied in this case is that the applicant is debarred from the scheme for the year in question (1998) and the following year (1999) as he was deemed to have made an intentional false declaration. The person named was notified in writing of the decision in January 1999. In February of 1999 the person named sought to have this decision reviewed. This is currently under consideration and a decision on the matter is expected shortly.
