  125.  Mr. Perry  Information on John Perry  Zoom on John Perry   asked the Minister for Agriculture, Food and Rural Development  Information on Joe Walsh  Zoom on Joe Walsh   if he will ensure that a person (details supplied) received his 22 month beef premium in view of the fact that he forgot to have the animals card stamped when they were slaughtered; and if he will make a statement on the matter. Minister for Agriculture, Food and Rural Development (Mr. Walsh): Information on Joe Walsh  Zoom on Joe Walsh  The person named applied for special beef premium on animal tag no. YNFT 0100C in December 1999 and was paid first age premium of £90.17. In March 2000 and again in April 2000 he applied for premium but because the date of birth of the animal was 3 September 1998 the animal did not reach the qualifying age for second age premium, 20 months, until 3 May 2000. The applicant did not apply for premium when the animal was eligible for second age premium. The animal was slaughtered on 3 October 2000.

Therefore, second age premium is not payable on this animal.

  126.  Mr. Perry  Information on John Perry  Zoom on John Perry   asked the Minister for Agriculture, Food and Rural Development  Information on Joe Walsh  Zoom on Joe Walsh   if he will intervene on a person's behalf (details supplied) and have a 2000 sheep headage payment released in view of the fact that she has rights of share of commonage and taking into consideration the fact that proof of commonage has been submitted by her solicitor; and if he will make a statement on the matter. Minister for Agriculture, Food and Rural Development (Mr. Walsh): Information on Joe Walsh  Zoom on Joe Walsh  The person named in this case included commonage in her 2000 area aid application but did not provide proof of her entitlement to a share of the commonage. The person named has now submitted the required proof. The 2000 area aid application has been cleared and any payments due will issue in the near future.

  127.  Mr. Perry  Information on John Perry  Zoom on John Perry   asked the Minister for Agriculture, Food and Rural Development  Information on Joe Walsh  Zoom on Joe Walsh   if he will intervene on a person's behalf (details supplied) and waive all penalties imposed on his 2000 cattle hedge and suckler cow payment; and if he will make a statement on the matter. Minister for Agriculture, Food and Rural Development (Mr. Walsh): Information on Joe Walsh  Zoom on Joe Walsh  The person named applied under the 2000 cattle headage scheme and the 2000 suckler cow premium scheme on 29 May 2000.

At an inspection of his herd carried out on 1 December 2000 it was found that three cows had lost both tags, one animal was not recorded in the official bovine herd register and two cows were rejected because it could not be fully established that they had been in his ownership and possession on the day of application. He was advised in writing of the position on the date of inspection that the possible penalty was the loss of all cattle headage and suckler cow premium grants for 2000 and 2001. He was formally notified in writing on 4 December 2000 that under the terms and conditions governing the schemes, as the rejected animals were greater than 20% of the eligible animals, no payments were due under the 2000 cattle headage or the suckler cow premium schemes. He was given the opportunity to have this decision reviewed by writing to the district inspector within 21 days, setting out any facts which he wished to put forward to support his case. Any such review will be treated as a matter of urgency.

Any payments due will issue as soon as possible.

  129.  Mr. Ring  Information on Michael Ring  Zoom on Michael Ring   asked the Minister for Agriculture, Food and Rural Development  Information on Joe Walsh  Zoom on Joe Walsh   when a person (details supplied) in County Mayo will receive 2000 sheep headage and premia. [29273/00]

Minister for Agriculture, Food and Rural Development (Mr. Walsh): Information on Joe Walsh  Zoom on Joe Walsh  The person included 106.34 hectares in his 2000 area aid application. An area of 106.17 hectares was determined which is some 0.17 hectares or 0.16 % less than the area claimed.

Under article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%. Therefore in this case no penalty is applied, leaving the area determined for payment purposes at 106.17 hectares. Any payments due will issue as soon as possible.

Minister for Agriculture, Food and Rural Development (Mr. Walsh): Information on Joe Walsh  Zoom on Joe Walsh  An issue arose relating to a commonage share which concerned both the person named and another participant in the scheme. The person named was informed of my Department's decision on his REPS application in a letter dated 22 August 2000. Following further correspondence, the decision is being reviewed by my Department. The outcome of this review will be notified to the person named within two weeks.
