  53.  Mr. Sargent  Information on Trevor Sargent  Zoom on Trevor Sargent   asked the Minister for Justice, Equality and Law Reform  Information on Michael McDowell  Zoom on Michael McDowell   his plans to open an inquiry into the Garda investigation and subsequent criminal proceedings surrounding the murder of a person (details supplied) in Tallaght in 1992; and if he will make a statement on the matter. [29740/05]

Minister for Justice, Equality and Law Reform (Mr. McDowell): Information on Michael McDowell  Zoom on Michael McDowell  I have had inquiries made in this matter and I am informed that the Garda authorities are satisfied that this case was the subject of a full and proper investigation which resulted in a person being charged on the directions of the Director of Public Prosecutions and subsequently dealt with by the courts. I understand that no other persons are sought with regard to this incident.

The courts are, subject only to the Constitution and the law, independent in the exercise of their judicial functions. I have no function in verdicts of the courts, nor is it open to me to intervene in court proceedings of this kind. I have been informed that the defendant in this case was acquitted on all charges by the jury who returned a verdict of “not guilty”.
