Government amendment No. 1: —

In page 3, before Section 5, to insert the following new section: —

Paragraph (b) of sub-section (1) and sub-section (2) of Section 71 of the Principal Act (which relates to delivery on sale of articles to which a registered design has been applied) are hereby repealed.

Mr. Bartley: Information on Gerald Bartley  Zoom on Gerald Bartley  Inadvertently, the reference to sub-section (2) which is there contained was omitted in paragraph 5 of the green print. Senators will see immediately, if they look at Section 5, that sub-section (2) hangs with sub-section (1) and goes automatically with sub-section (1). As I say, it was inadvertently omitted and I ask the Seanad to allow us to correct the inadvertency now.

Mr. Bartley: Information on Gerald Bartley  Zoom on Gerald Bartley  The acceptance of this amendment involves the deletion of Section 5 of the Bill.

Section 5 deleted.

Sections 6 to 12, inclusive, agreed to.

Government amendment No. 2: —

In sub-section (1), page 5, line 18, to delete “its organs and specialised agencies,” and substitute “the organs thereof and the specialised agencies in relationship therewith.”

Mr. Bartley: Information on Gerald Bartley  Zoom on Gerald Bartley  The Seanad will recognise that no substantial change is being effected by the substitute words, but the substitute words have been recommended as the proper words in this context.

[346]Dr. O'Donovan: Information on John O'Donovan  Zoom on John O'Donovan  I think we had better not comment on that. I seems to be a piece of legal phraseology that has no great merit.
